1.1 Any references to "OfSpectrum, Inc.", "Windears", "us", "we", or "our" means the Site's proprietary owners, OfSpectrum, Inc.

This information is collected on the Payout page for identity verification and to comply with the US tax reporting obligations (IRS Form 1099-K), as required by our third-party payment processor, Stripe.

2.3 Information we receive from third parties

We may receive information about you (including personal information) from third parties. If you access our Site through a third-party connection or log-in, for example, through Google account, that third party may pass certain information about your use of its service to us. This information could include, but is not limited to, the user ID associated with your account, an access token necessary to access that third party service, any information that you have permitted the third party to share with us, and any information that you have made public in connection with those third party services. If you'd like to unlink your third party account from our Site, you can adjust your settings in the third party service and we will no longer receive information collected about you in connection with that service.

This includes allowing you to create a Site account and log in to your account, giving you access to our services and products, and recognising you across different services and devices. 3.1.9 Please note that we prohibit the sale of Google user data to third-parties.

3.1.10 Fulfilling tax and regulatory obligations: We use the TIN/SSN and Date of Birth to securely transmit this information to our payment processor, Stripe, solely for identity verification and compliance with US tax laws (e.g., IRS Form 1099-K reporting) and preventing mandatory backup withholding.

You may refuse to provide the personal information we requested at any time, but this may limit or prohibit your access to our products and services. You may withdraw your consent for personal information use at any time by contacting us through support@windears.com.

3.2 Legal Basis for Processing (EEA/UK Users)

If you are a resident of the European Economic Area (EEA) or the United Kingdom (UK), we process your personal data only when we have a valid legal basis to do so, including:

3.2.1 Contractual Necessity: We need to process your personal data to perform our contract with you, specifically to provide the Services described in our Terms of Service (e.g., account creation, payment processing, delivering watermarking services).

3.2.2 Legitimate Interest: Processing is necessary for our legitimate interests, providing these interests do not override your rights and freedom. This includes: improving our services, preventing fraud, ensuring network and information security, and conducting data analytics.

3.2.3 Legal Obligations: Processing is necessary to comply with a legal obligation (e.g., retaining records for tax purposes or responding to lawful requests).

3.2.4 Consent: We rely on your consent to process your personal data for specific purposes (e.g., optional marketing communications). You have the right to withdraw your consent at any time.

4. Third-Party Sharing

Outside our authorized personnel employed by us, we only share your personal information with third parties that meet the data privacy conditions described in this Privacy Policy. These third parties help us to better use your personal information to provide our products and services. These parties include:

These are companies that assist us in delivering our services, such as cloud storage providers, online payment solutions providers (like Stripe), but only as necessary and under strict confidentiality agreements. Please note that your SSN/TIN and Date of Birth are securely shared directly with Stripe, which is solely responsible for its storage and compliance as a payment processor, and Windears does not retain this highly sensitive data. Stripe's handling of this data is governed by the Stripe Privacy Policy.

4.3 Legal disclosures

We may be required to disclose personal data for legal process and lawful requests by public authorities. We may need to disclose personal information if it is required by law, subpoena, and other legal processes. We may also disclose personal information if we believe the disclosure is necessary to: (a) investigate suspected or actual illegal activities; (b) assist government enforcement agencies; (c) enforce our Privacy Policy, Terms of Service, contracts, and any other agreements you signed; (d) investigate and defend ourselves against any claims, accuses, or allegations; (e) protect the security or our Site and Services; (f) protect the rights and safety of Windears, our users, personnel or others.

4.4 Cross-border data transfers

We provide our services to users outside of the United States, and may cooperate with third-parties outside of the United States, such as universities and signal processing labs. We may process data globally and rely on legally-provided mechanisms, such as the Standard Contractual Clauses (SCCs) to lawfully transfer data across borders. Countries where we process data may have different laws and different levels of data privacy protection compared to the user's own country.

5. Data Security

We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor and update our systems for possible attacks and vulnerabilities. Specifically, highly sensitive data, such as your full TIN/SSN and Date of Birth, is securely transmitted to our payment processor, Stripe, and is not stored permanently on our servers. However, we cannot guarantee the security of data. There is no guarantee that all data may not be accessed, disclosed, altered, or destroyed by breach of any of our security safeguards.

6. User Rights

You have the right to access and control your personal information, subject to applicable laws:

6.1 Right to access and portability: You have the right to request access to the categories and the specific pieces of personal information we have collected about you, and to receive a copy of your personal data in a structured, commonly used, and machine-readable format.

6.2 Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal data we hold about you.

6.3 Right to Erasure (Deletion): You have the right to request the deletion of your personal information, subject to certain legal exceptions (e.g., if we need the data to comply with a legal obligation).

6.4 Right to Object or Restrict Processing (EEA/UK Only): You have the right to object to or request restriction of our processing of your personal data in certain circumstances.

6.5 Right to Opt-Out of Sales/Sharing: Windears does not sell you personal data in the traditional sense. To the extent "sharing" data for cross-context behavioral advertising (as defined by applicable state law) constitutes a "sale," you have the right to opt-out, and we will honor your request.

6.6 Lodge a Complaint: If you are in the EEA/UK, you have the right to lodge a complaint with your local supervisory authority.

6.7 Change your account information, such as your username or password, banking account information, on our website by logging into your account. You may change or delete your profile information and banking information on our Website, but deleting this information may limit your access to our Products and Services. Some information changes may not be located on our Website, but on related third party websites.

6.8 You can stop receiving advertisements, marketing email, or other communication related with commercial promotion from us at any time by clicking on "unsubscribe link" or other similar links in the relevant communication. However, you cannot unsubscribe certain important notification emails.

6.9 We may limit or reject your request for information changes and deletes in certain cases, including without limitation where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case question, where the rights of other persons or Windears would be violated, or as required by law or governance purposes.

7. Data Retention

We retain your account information as long as you keep your account open or as needed to provide you Services. This includes data you or others provided to us and data generated or inferred from your use of our Products and Services. The retention period for specific types of personal data is determined by the necessity of the data for legal, accounting, security, or regulatory purposes, and based on the length of time needed to fulfill the purposes outlined in this policy. In some cases, we may not retain some data you provided, which we believe will not influence your future use of our Products and Services. And in some cases, we may choose to retain certain information in a depersonalized or aggregated form.

8. Minority's Policy

Our services are not intended for minors (individuals under the age of 18), and we do not knowingly collect personal data from children. If we become aware that a child's data has been collected, we will suspend and remove it promptly. If we discover that a minor under 18 has provided us with personal information, please contact us.

Our Site may allow access to third party content and services with your prior consent. We are not responsible for the practices employed by websites or services accessible from the Site, including the information or content contained within these websites or services. When you use a link to go from our Site to another website, our Privacy Policy and any other agreements do not apply to third-party websites or services. 10. Changes to Our Privacy Policy

If you object to any changes, you may close your account or stop using our Products and Services.

You acknowledge that your continued use of our Products and Services after we publish or send a notice about the update of this Privacy Policy means that the collection, use and sharing of your personal information is subject to the updated Privacy Policy, as of its effective date.

11. Account Closure

We permanently delete account information, including any project, media, audio or text information uploaded by you, within 30 days of account termination, except as noted below.

We retain your personal information even after you have closed your account if it is reasonably necessary to comply with legal obligations, meet regulatory requirements (including retaining tax and transaction records as required by law), resolve disputes, charge uncollected fees, remain security, prevent fraud and abuse, enforce our Terms of Service, fulfill your request to "unsubscribe" from further messages from us, or your information is necessary to protect others users and Windears' rights.
